These terms govern your use of PingMe and outline our mutual rights and responsibilities for reminder services, including SMS and voice call features.

📋 Agreement to Terms

By downloading, installing, or using the PingMe mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use our App.

These Terms constitute a legal agreement between you and PingMe ("we," "us," or "our"). They apply to your use of the App, our website, SMS services, voice call services, and any related features.

Important: By creating an account or using our services, you confirm that you are at least 16 years old and have the legal capacity to enter into this agreement.

Age Requirements

Due to the nature of SMS and voice call services, PingMe requires users to be at least 16 years old. Users under 18 should have parental permission to use communication features that may incur charges.

📱 App Usage & License

License to Use

We grant you a limited, non-exclusive, non-transferable license to use PingMe for personal, non-commercial purposes. This license is subject to these Terms and may be revoked for violations.

Acceptable Use

You agree to use PingMe responsibly and in accordance with its intended purpose. You may:

  • Create personal reminders and notifications
  • Use SMS and voice call features for legitimate reminders
  • Share reminders with family members and colleagues
  • Use voice-to-text features for convenience
  • Set up recurring reminders and custom schedules

Prohibited Activities

You may NOT use PingMe to:

  • Spam or harass: Send unwanted messages or calls to others
  • Illegal activities: Create reminders for illegal actions or content
  • Abuse services: Excessively use SMS/voice features to drive up costs
  • Impersonate others: Create reminders pretending to be someone else
  • Commercial spam: Use the service for marketing or advertising purposes
  • System abuse: Attempt to hack, reverse engineer, or compromise the App
  • Emergency services: Use for life-threatening emergencies (call 911/local emergency services instead)
Critical Reminders: While PingMe is highly reliable, never rely solely on the app for life-threatening medication reminders or critical safety notifications. Always have backup reminder systems for essential health and safety needs.

Subscription Plans

PingMe offers the following subscription plans:

  • Free Plan: 10 reminders per month with basic push notifications
  • Premium Monthly: $4.99 per month for unlimited features
  • Premium Annual: $49.99 per year (equivalent to 10 months, saving 17%)

Premium Features

Premium subscribers receive:

  • Unlimited reminder creation
  • SMS notification delivery
  • Voice call reminder services
  • Multi-recipient reminder sharing
  • Voice-to-text reminder creation
  • Custom recurring intervals
  • Priority customer support
  • Advanced analytics and insights

Billing & Payment

All subscriptions are processed through your device's app store (Apple App Store or Google Play Store). By subscribing, you agree to:

  • Pay the subscription fee as charged by the app store
  • Automatic renewal unless cancelled at least 24 hours before the current period ends
  • The app store's terms and conditions for in-app purchases
  • Potential price changes with 30 days notice

Free Trial

New users receive a 7-day free trial of Premium features. You can cancel anytime during the trial without charge. If you don't cancel, your paid subscription begins automatically.

Refunds & Cancellation

You can cancel your subscription anytime through your app store account settings. Cancellation takes effect at the end of your current billing period. Refunds are handled according to your app store's refund policy (Apple or Google).

No Partial Refunds: We cannot provide partial refunds for unused SMS messages or voice calls. Plan your usage accordingly and monitor your account regularly.

📞 SMS & Voice Call Services

Service Description

PingMe's Premium subscribers can receive reminder notifications via:

  • SMS Text Messages: Sent to your phone number at scheduled times
  • Voice Calls: Automated calls with your reminder message played back
  • Multi-recipient delivery: SMS and calls to shared recipient phone numbers

Service Limitations

  • Delivery dependent on carriers: We cannot guarantee delivery due to carrier issues
  • International rates may apply: Check with your phone provider for potential charges
  • Emergency services limitation: Not intended for emergency or life-threatening situations
  • Network dependency: Requires cellular network coverage for delivery
  • Spam filters: Some carriers may filter automated messages

Usage Limits & Fair Use

To maintain service quality and prevent abuse:

  • SMS and voice calls are limited to reasonable personal use
  • Excessive usage (>1000 messages/calls per month) may be subject to review
  • Commercial use or spam will result in immediate account termination
  • We reserve the right to temporarily suspend service for abuse

Third-Party Providers

SMS and voice services are provided through third-party partners (such as Twilio). These services are subject to:

  • Third-party terms of service and privacy policies
  • Occasional service outages or maintenance windows
  • Compliance with telecommunications regulations
  • Carrier-specific delivery requirements and restrictions
Delivery Guarantee: While we strive for 99.9% delivery success, factors beyond our control (carrier issues, network problems, phone settings) may affect delivery. We recommend using multiple notification methods for critical reminders.

👤 User Responsibilities

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized account access
  • Keeping your contact information up to date
  • Ensuring you have permission to send reminders to other phone numbers

Content Responsibility

You are solely responsible for:

  • The content of your reminders and messages
  • Ensuring reminder content is legal and appropriate
  • Obtaining consent before sending reminders to others
  • Compliance with applicable laws in your jurisdiction
  • Any charges incurred for SMS or voice call services

Phone Number Verification

For SMS and voice call features, you must:

  • Provide accurate phone numbers
  • Verify ownership of your primary phone number
  • Obtain permission before adding others' phone numbers
  • Keep recipient contact information current
  • Remove phone numbers when requested by the owner
Consent Required: You must have explicit permission to send SMS or voice call reminders to any phone number other than your own. Unauthorized messaging may violate telecommunications laws and result in account termination.

PingMe's Intellectual Property

The PingMe app, including its design, functionality, algorithms, and branding, is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the app or its components
  • Use our trademarks, logos, or branding without permission
  • Create derivative works or competing apps based on PingMe
  • Reverse engineer or extract source code
  • Remove or modify any copyright or proprietary notices

Your Content Rights

You retain ownership of your reminder content, but grant us necessary licenses to:

  • Store and process your reminders to provide the service
  • Send SMS and voice call notifications as requested
  • Back up your data for account recovery
  • Analyze usage patterns to improve the service (anonymized data only)

Voice Recordings

When you use voice-to-text features:

  • Your voice recordings are processed and immediately converted to text
  • Original audio is deleted after successful transcription
  • We do not store or analyze voice recordings for other purposes
  • You consent to temporary processing for transcription services

🔧 Service Availability & Support

Service Uptime

We strive to maintain 99.9% uptime for PingMe services, but we don't guarantee uninterrupted availability. The service may be temporarily unavailable due to:

  • Scheduled maintenance and updates
  • Technical issues or server problems
  • Third-party service provider outages
  • Natural disasters or force majeure events
  • Security incidents requiring immediate response

Support Services

We provide customer support through:

  • In-app help: Available 24/7 through the app
  • Email support: Response within 24-48 hours
  • Priority support: Faster response for Premium subscribers
  • Knowledge base: Self-service help articles and FAQs

Service Modifications

We may modify, suspend, or discontinue any part of PingMe at any time with reasonable notice. We will:

  • Provide at least 30 days notice for major feature changes
  • Offer data export options before service discontinuation
  • Provide pro-rated refunds for discontinued paid features
  • Maintain core reminder functionality whenever possible

Service Disclaimers

PingMe is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, including:

  • Guaranteed delivery of SMS or voice call reminders
  • Uninterrupted or error-free service operation
  • Compatibility with all devices or carriers
  • Accuracy of third-party services (SMS/voice providers)
  • Suitability for any particular purpose

Limitation of Liability

To the fullest extent permitted by law, PingMe and its affiliates shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the amount paid for the service in the past 12 months
  • Failures due to third-party services or network issues
  • Missed reminders due to service outages or technical problems
Critical Limitation: PingMe is not suitable for life-threatening situations, emergency services, or critical medical reminders where failure could result in serious harm. Use appropriate emergency systems and consult healthcare providers for critical medical scheduling.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, terrorism, pandemics, or third-party service failures.

Termination by You

You may terminate your account at any time by:

  • Deleting your account through the app settings
  • Cancelling your subscription through your app store
  • Contacting customer support for assistance
  • Uninstalling the app (account data remains for 30 days)

Termination by PingMe

We may suspend or terminate your account for:

  • Violation of these Terms of Service
  • Abuse of SMS or voice call services
  • Non-payment of subscription fees
  • Illegal use or harassment of other users
  • Creating security risks or system abuse
  • Providing false information during account creation

Effect of Termination

Upon account termination:

  • Your right to use PingMe ends immediately
  • All scheduled reminders are cancelled
  • Account data is deleted after a 30-day grace period
  • Outstanding subscription fees remain due
  • You may export your data before the grace period expires

Data Recovery

After termination, you have 30 days to request data recovery or export. After this period, all data is permanently deleted and cannot be recovered.

Governing Law

These Terms are governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Delaware.

Dispute Resolution

Before filing any lawsuit, both parties agree to attempt resolution through:

  • Direct negotiation between the parties
  • Mediation through a mutually agreed mediator
  • Binding arbitration if mediation fails

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects our intent.

Changes to Terms

We may update these Terms to reflect changes in our services, legal requirements, or business practices. When we make significant changes:

  • We'll notify you through the app and via email at least 30 days in advance
  • Update the "Last Updated" date at the top of this document
  • Provide a summary of key changes
  • For major changes affecting your rights, we may request your consent

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PingMe. They supersede all prior agreements, understandings, and communications.
