1. Acceptance of Terms
By downloading, installing, accessing, or using the Monday App mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Monday App ("Company," "we," "us," or "our") regarding your use of the App and all related services.
2. Description of Service
Monday App is a workplace devotional application designed to help Christian professionals transform their Monday mindset and integrate faith into their work week. Our services include:
- AI-Powered Devotionals: Personalized daily devotional content focused on workplace spirituality and Monday motivation
- Spiritual Check-ins: Tools for tracking your spiritual and emotional well-being throughout the work week
- Community Challenges: Faith-based workplace challenges that connect you with other Christian professionals
- Progress Tracking: Personal analytics to monitor your spiritual growth and engagement
- Notification System: Customizable reminders for devotionals, check-ins, and spiritual practices
- Content Sharing: Ability to share inspirational content with colleagues and friends
3. User Accounts and Registration
3.1 Account Creation
To access certain features of Monday App, you must create an account by providing accurate, complete, and current information. You agree to:
- Provide truthful and accurate registration information
- Maintain the security and confidentiality of your account credentials
- Update your account information to keep it current and accurate
- Be fully responsible for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account or security breach
3.2 Account Requirements
- Age Requirement: You must be at least 13 years old to create an account
- Individual Use: One person may not create multiple accounts
- Personal Accounts: Accounts are for individual use only and may not be shared or transferred
- Valid Email: You must provide a valid email address for account verification and communication
- Professional Context: While designed for workplace spirituality, personal use is permitted
4. User Conduct and Responsibilities
4.1 Acceptable Use
You agree to use Monday App only for lawful purposes and in accordance with these Terms. You will NOT:
- Use the App for any illegal, harmful, or unauthorized purpose
- Violate any local, state, national, or international law or regulation
- Share your account credentials with others or allow others to use your account
- Attempt to gain unauthorized access to our systems, other users' accounts, or protected areas
- Use automated scripts, bots, or tools to access or interact with the App
- Upload, share, or distribute malicious software, viruses, or harmful content
- Interfere with, disrupt, or overload the App's functionality, servers, or network
- Reverse engineer, decompile, disassemble, or attempt to derive source code from the App
4.2 Professional Conduct
As Monday App is designed for workplace spirituality, you agree to:
- Maintain professionalism when sharing content with colleagues
- Respect diverse faith traditions and beliefs within the community
- Use appropriate language and content suitable for professional environments
- Not proselytize or engage in aggressive religious debate
- Respect workplace policies regarding religious expression
5. Intellectual Property Rights
5.1 Our Intellectual Property
The App and all content, features, and functionality are owned by Monday App and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes:
- Software code, algorithms, and AI-powered content generation systems
- User interface design, graphics, and visual elements
- Devotional content, spiritual resources, and curated materials
- App name, logos, branding, and trademarks
- Features, functionality concepts, and user experience design
- Database structures and data organization methods
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. This license does not include:
- Any resale or commercial use of the App or its content
- Collection or use of product listings, descriptions, or pricing
- Any derivative use of the App or its content
- Any downloading or copying of account information
5.3 User Content
You retain ownership of content you create, upload, or share within the App. However, you grant us a limited, worldwide, royalty-free license to use such content solely for:
- Providing and improving our services
- Facilitating community features and challenges
- Generating anonymized insights for app improvement
- Ensuring safety and compliance with our terms
6. Premium Subscriptions and Payments
6.1 Premium Features
Monday App offers premium subscriptions that provide enhanced features including:
- Unlimited Content: Access to all devotionals, challenges, and premium spiritual resources
- Advanced Analytics: Detailed insights into your spiritual growth and engagement patterns
- Priority Support: Faster response times for customer service inquiries
- Ad-Free Experience: Use the app without advertisements or promotional content
- Exclusive Content: Access to premium devotionals and special challenges
- Data Export: Ability to export your spiritual journey data and progress
6.2 Subscription Terms
- Processing: All subscriptions are processed through the Apple App Store
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Cancellation: You can cancel anytime through your Apple ID account settings
- Billing Cycle: You will be charged at confirmation of purchase and for each renewal period
- Price Changes: Subscription prices may change with 30 days notice
- Free Trial: New users receive a 7-day free trial of Premium features
6.3 Payment and Refunds
Important Payment Information
All subscription payments, billing, and refunds are handled exclusively by Apple through the App Store. We do not have access to your payment information. For subscription issues, billing disputes, or refund requests, contact Apple Support directly or visit reportaproblem.apple.com.
7. User Content and Community Guidelines
7.1 Content Standards
When creating or sharing content within Monday App, you agree that your content will:
- Be respectful, encouraging, and appropriate for a faith-based professional community
- Not contain offensive, discriminatory, hateful, or harmful material
- Not infringe on the intellectual property rights of others
- Not contain false, misleading, or deceptive information
- Comply with applicable laws and regulations
- Respect the diverse backgrounds and beliefs of other users
7.2 Community Guidelines
- Respect: Treat all community members with kindness and respect
- Authenticity: Be genuine in your spiritual journey and sharing
- Encouragement: Focus on building up and supporting fellow professionals
- Privacy: Respect others' privacy and personal information
- Appropriate Sharing: Only share content suitable for professional environments
7.3 Content Moderation
We reserve the right to review, moderate, or remove any user content that violates these Terms or our community guidelines. This includes content that is:
- Inappropriate for a professional faith-based community
- Spam, promotional, or commercial in nature
- Harmful, threatening, or harassing
- Infringing on intellectual property rights
- Illegal or violating applicable laws
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding the accuracy, reliability, completeness, or timeliness of content
- Warranties that the App will be uninterrupted, secure, error-free, or virus-free
- Warranties regarding the accuracy of spiritual content, religious interpretations, or AI-generated devotionals
- Warranties that the App will meet your specific requirements or expectations
Spiritual Content Disclaimer
Monday App provides general spiritual content and workplace devotional tools for personal growth and inspiration. We do not provide professional religious counseling, theological advice, pastoral care, or substitute for spiritual leadership. Always consult with your spiritual leaders, pastors, or religious advisors for specific religious guidance, doctrinal questions, or personal spiritual matters.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT SHALL MONDAY APP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
- OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PREMIUM SUBSCRIPTIONS IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR ANY LOSS OF DATA, CONTENT, PROFITS, BUSINESS, OR INTERRUPTION OF SERVICE
- WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES, INTEGRATIONS, OR EXTERNAL LINKS
- WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
10. Indemnification
You agree to defend, indemnify, and hold harmless Monday App and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to:
- Your violation of these Terms or applicable laws
- Your use or misuse of the App or its services
- Your violation of any third-party rights, including intellectual property rights
- Any content you create, upload, or share through the App
- Your conduct in connection with the App or community features
- Any false or misleading information you provide
11. Termination
11.1 Termination by You
You may terminate your account and these Terms at any time by:
- Deleting the App from your device
- Cancelling any active Premium subscriptions through Apple
- Contacting us to request permanent account deletion
- Ceasing all use of the App and its services
11.2 Termination by Us
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:
- Violation of these Terms or our community guidelines
- Fraudulent, illegal, or harmful activity
- Abuse of the service, other users, or our support team
- Extended periods of account inactivity (over 2 years)
- Technical or security concerns
- Legal requirements or court orders
11.3 Effects of Termination
Upon termination of your account:
- Your right to access and use the App immediately ceases
- Your account data and spiritual journey information may be deleted within 30 days
- You remain liable for any charges incurred before termination
- Active subscriptions continue until the end of the current billing period
- Surviving provisions (warranties, liability limitations, indemnification) remain in effect
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any legal disputes arising under these Terms shall be resolved through:
- Initial Contact: Good faith effort to resolve disputes through our support team
- Jurisdiction: Courts of California, and you consent to personal jurisdiction of such courts
- Class Action Waiver: Disputes must be resolved individually, not as part of a class action
- Time Limitation: Claims must be filed within one year of the cause of action arising
13. Changes to These Terms
We reserve the right to modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. When we make changes:
- Notification: We will post updated Terms in the App and on our website
- Effective Date: We will update the "Effective Date" at the top of this document
- Material Changes: For significant changes, we will provide prominent notice through the App or email
- Continued Use: Your continued use after changes constitutes acceptance of the updated Terms
- Disagreement: If you disagree with changes, you may terminate your account before they take effect
