Terms of Service

1. Acceptance of Terms

By downloading, installing, or using MedMinder ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and MedMinder.

3. Description of Service

MedMinder provides a mobile application designed to help users track and receive reminders for their medications. The service includes medication management, reminder notifications, adherence tracking, and related features. The App is available in both free and premium (paid subscription) versions.

4. User Accounts and Registration

• You must create an account to use MedMinder
• You must provide accurate, complete, and current information
• You must be at least 13 years old to use the App
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to refuse service or terminate accounts at our discretion

As a user of MedMinder, you agree to:

• Enter accurate medication information (names, dosages, schedules)
• Verify all medication information with your healthcare provider
• Take responsibility for your own medication adherence
• Enable notifications to receive medication reminders
• Keep your device charged and functional
• Maintain internet connectivity for cloud features (Premium)
• Update medication information when prescriptions change
• Not rely solely on the App for critical medication timing

You agree NOT to:

• Use the App for any illegal purpose
• Share your account credentials with others
• Create multiple accounts to circumvent subscription requirements
• Attempt to hack, reverse engineer, or disrupt the App
• Use automated tools or bots to access the App
• Store medication information for others without their consent
• Share protected health information without authorization
• Violate any applicable laws, regulations, or third-party rights

7. Intellectual Property

• All content, features, functionality, and design are owned by MedMinder
• The MedMinder name, logo, and branding are registered trademarks
• You may not copy, modify, distribute, or create derivative works
• You may not use our trademarks without written permission
• Your medication data remains your property
• By using the App, you grant us a license to store, process, and display your data to provide the service

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using MedMinder, you consent to our data practices as described in the Privacy Policy.

• We implement HIPAA-level security practices
• All data is encrypted in transit and at rest
• We never sell or share your medication information
• You can export or delete your data at any time

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MedMinder and its owners, employees, and affiliates shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for missed medications, health complications, data loss, or lost profits
• We are not responsible for notification failures due to device issues, network problems, or user settings
• We are not responsible for medication errors or adverse health outcomes
• Our maximum liability is limited to the amount you paid for the service in the past 12 months
• Some jurisdictions do not allow limitation of liability for personal injury, so this may not apply to you

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Fitness for a particular purpose or medical use
• Non-infringement of third-party rights
• Uninterrupted, timely, or error-free service
• Accuracy or reliability of notifications
• Compatibility with all devices or operating systems
• Freedom from viruses or harmful components

11. Termination

• We may suspend or terminate your account for violations of these Terms
• We may terminate accounts for fraudulent activity or abuse
• You may delete your account at any time through app settings
• Upon termination, your right to use the App ceases immediately
• All data will be deleted within 30 days of account deletion
• Premium subscriptions will not be refunded upon termination for cause
• Provisions regarding liability, warranties, and intellectual property survive termination

12. Changes to Terms

• We reserve the right to modify these Terms at any time
• Material changes will be communicated through in-app notification or email
• Continued use after changes constitutes acceptance of the new Terms
• If you do not agree to changes, you must stop using the App and delete your account
• The "Last Updated" date will be revised when changes are made

13. Apple App Store Terms

• MedMinder is licensed, not sold, to you for use strictly in accordance with these Terms
• Subscriptions are purchased through Apple In-App Purchase
• Apple is not responsible for the App, these Terms, or any claims related to the App
• You agree to Apple's Licensed Application End User License Agreement
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims regarding the App
• In case of conflict between these Terms and Apple's terms, Apple's terms take precedence regarding payment and subscriptions

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in [Your Jurisdiction], and you consent to personal jurisdiction in such courts.

15. Dispute Resolution

• Any disputes arising from these Terms or use of the App will be resolved through binding arbitration
• Arbitration will be conducted by the American Arbitration Association (AAA)
• You waive the right to participate in class action lawsuits or class-wide arbitration
• Small claims court remains an option for qualifying disputes under $10,000
• Notwithstanding arbitration, either party may seek injunctive relief in court

16. Indemnification

You agree to indemnify, defend, and hold harmless MedMinder and its owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your negligence or willful misconduct
• Any medication errors or health issues resulting from App use

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MedMinder regarding use of the App and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
