Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the CyberQuestPro mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and CyberQuestPro ("Company," "we," "us," or "our").

2. License to Use

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App on iOS devices that you own or control
• Access and use the App's features and content for personal, non-commercial use
• Receive updates and new features as they become available

2.2 License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or other proprietary notices
• Use the App for any commercial purpose or on behalf of any third party
• Transfer, rent, lease, lend, sell, or sublicense the App

3. Subscription Terms and Billing

3.1 Subscription Plans

CyberQuestPro offers the following subscription options:

• Premium Monthly: $9.99 per month
• Premium Annual: $49.99 per year
• Virtual Lab Access: $19.99 per month (add-on)

3.2 Auto-Renewal and Billing

• Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• Subscription fees are charged through the Apple App Store
• Prices may vary by location and are subject to change with notice

3.3 Free Trial Terms

If offered, free trials:

• Provide full access to premium features for the trial period
• Automatically convert to paid subscriptions unless canceled
• Can only be used once per Apple ID
• May be canceled anytime during the trial period without charge

3.4 Cancellation Policy

To cancel your subscription:

1. Open the Settings app on your iOS device
2. Tap your name, then tap Subscriptions
3. Select CyberQuestPro and tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You retain access to premium features until then.

4. User Account Responsibilities

4.1 Account Creation

To use certain features, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your contact information remains current

4.2 Account Security

• You may not share your account credentials with others
• Each subscription is for individual use only
• We reserve the right to suspend accounts showing signs of unauthorized sharing
• You must be at least 13 years old to create an account

5. Intellectual Property Rights

5.1 Our Content

The App and all content, including but not limited to:

• Practice questions and explanations
• Learning materials and courses
• Software code and algorithms
• Graphics, logos, and design elements
• Text, images, and multimedia content

Are owned by CyberQuestPro or our licensors and protected by intellectual property laws.

5.2 User Content

You retain ownership of content you create or submit through the App. However, you grant us a license to use such content for:

• Providing and improving our services
• Generating anonymized analytics and insights
• Technical support and troubleshooting

6. Content and Usage Restrictions

6.1 Prohibited Uses

You agree NOT to:

• Share, distribute, or reproduce any content from the App
• Use the App to cheat on actual certification exams
• Create accounts for others or allow others to use your account
• Attempt to gain unauthorized access to our systems
• Use automated tools to access or interact with the App
• Upload malicious software or attempt to disrupt our services

6.2 Educational Use Only

6.3 Reverse Engineering Prohibition

You may not reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law. Any attempt to do so may result in immediate termination of your access.

7. Disclaimers and Warranties

7.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the App will be uninterrupted or error-free

7.2 No Guarantee of Certification Success

While our App is designed to help you prepare for cybersecurity certifications, we do not guarantee that you will pass any certification exam. Success depends on many factors including your study habits, prior experience, and exam conditions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• IN NO EVENT SHALL CYBERQUESTPRO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR ANY LOSS OF DATA, BUSINESS, OR PROFITS ARISING FROM YOUR USE OF THE APP

9. Termination

9.1 Termination by You

You may terminate this Agreement at any time by:

• Canceling your subscription through your Apple ID account
• Deleting the App from all your devices
• Ceasing all use of our services

9.2 Termination by Us

We may terminate your access immediately without notice if you:

• Violate these Terms of Use
• Engage in fraudulent or illegal activities
• Attempt to compromise the security of our systems
• Share your account with unauthorized users

9.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• You must delete the App from all devices
• We may delete your account data after 30 days
• Surviving provisions (liability limitations, governing law) remain in effect

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved in the courts of California, and you consent to the jurisdiction of such courts.

11. Changes to These Terms

We may modify these Terms at any time. When we do:

• We will post the updated Terms on this page
• We will update the "Last Updated" date
• For material changes, we will notify users through the App or email
• Continued use of the App after changes constitutes acceptance

If you do not agree to modified Terms, you should discontinue use of the App and cancel your subscription.
