By downloading, installing, or using the NatureGuard mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

NatureGuard is an outdoor safety and nature identification application that provides:

• AI-powered species identification for plants, animals, and insects
• Real-time weather alerts and forecasts
• First aid guides and emergency procedures
• Trip planning checklists and safety resources
• Emergency contact information
• Offline access to safety databases (premium feature)

Service availability may vary by geographic location and is subject to periodic maintenance and updates.

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

• Safeguarding your account password and restricting access to your device
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Maintaining the security of your account credentials

NatureGuard offers both free and premium subscription services:

Free Features:

• Basic species identification
• Current weather information
• Emergency contact numbers
• Basic first aid guides

Premium Subscription ($4.99/month or $49.99/year):

• Advanced AI recognition with higher accuracy
• Offline mode for remote areas
• 7-day weather forecasts
• Detailed first aid guides and emergency procedures
• Unlimited custom trip checklists
• Priority customer support

Billing: Subscriptions are billed in advance through your Apple ID account. Auto-renewal occurs unless cancelled at least 24 hours before the end of the current period.

No Free Trials: We provide instant access to premium features without free trial periods.

Cancellation: You can cancel your subscription anytime through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

You agree not to use NatureGuard for any unlawful purpose or in any way that could damage, disable, or impair the Service. Prohibited uses include:

• Using the app to engage in illegal hunting, poaching, or wildlife harassment
• Relying solely on the app for critical safety decisions without proper training
• Attempting to reverse engineer, decompile, or extract source code
• Using the service for commercial purposes without authorization
• Sharing account credentials with others
• Introducing viruses, malware, or other harmful code

Emergency Response: In any emergency situation, prioritize calling professional emergency services before consulting the app. NatureGuard is designed to supplement, not replace, proper emergency response procedures.

Safety Guidelines:

• Wildlife encounters: Always maintain safe distance from wild animals regardless of identification
• Plant identification: Never consume plants identified by the app without expert verification
• Mushroom safety: Never eat mushrooms identified by the app - misidentification can be fatal
• Venomous species: Treat any snake, spider, or insect as potentially dangerous
• Regional variations: Species appearance can vary by location and season

User Assumption of Risk: You acknowledge that outdoor activities involve inherent risks, and you assume all responsibility for your safety decisions while using NatureGuard.

The Service and its original content, features, and functionality are and will remain the exclusive property of NatureGuard and its licensors. The Service is protected by copyright, trademark, and other laws.

You are granted a limited, non-exclusive, non-transferable license to:

• Download and use the NatureGuard app on your personal devices
• Access and use the Service for personal, non-commercial purposes

You may not:

• Reproduce, distribute, or create derivative works from our content
• Use our intellectual property for commercial purposes without permission
• Remove or alter any copyright, trademark, or proprietary notices

To the maximum extent permitted by applicable law, NatureGuard shall not be liable for:

• Injuries or accidents resulting from outdoor activities
• Incorrect species identification or safety information
• Weather-related incidents or forecast inaccuracies
• Medical emergencies or first aid treatment outcomes
• Equipment failure or navigation errors
• Service interruptions in remote areas
• Indirect, incidental, special, consequential, or punitive damages

Our total liability to you for all claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Use at Your Own Risk: You acknowledge that outdoor activities are inherently dangerous and that you engage in them at your own risk, with or without the assistance of our app.

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

Your access to and use of the Service is also subject to all applicable federal, state, and local laws and regulations.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
