By downloading, installing, or using the Fairway Fundamentals mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Fairway Fundamentals. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

Fairway Fundamentals is a golf training mobile application that provides:

• AI-powered golf swing analysis
• Video tutorials from professional instructors
• Written guides on golf technique and strategy
• Progress tracking and handicap calculation
• Equipment recommendations
• Community features including forums and leaderboards (Premium)
• Access to premium tournaments (Premium)

The App is available on iOS and Android devices and offers both free and premium subscription tiers.

3. AI Analysis Disclaimer

• AI analysis is based on algorithmic interpretation and may not capture all nuances of your swing
• Results should be used as general guidance, not definitive coaching advice
• Individual physical conditions, limitations, or injuries may affect the applicability of suggestions
• We recommend consulting with a golf professional for personalized instruction
• Following AI suggestions is at your own risk; we are not liable for any injuries or negative outcomes

4. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Be at least 13 years old (or the minimum age in your jurisdiction)

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Terms

Free Tier

The free tier includes basic features with limitations (e.g., 1 AI swing analysis per day, basic tutorials).

Premium Subscription

Premium subscription is available at $9.99/month and includes unlimited AI analysis, all content, community features, and priority support.

Auto-Renewal

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Free trial conversions must be cancelled before trial ends to avoid charges

Price Changes

We may change subscription prices with 30 days' notice. Price changes will take effect at your next renewal date. Continued use constitutes acceptance of the new price.

6. User-Generated Content

Your Swing Videos

You retain ownership of swing videos and other content you upload to the App. By uploading content, you grant us a limited license to:

• Process and analyze your videos using our AI
• Store your videos to provide the service
• Use anonymized data to improve our AI (with your consent)

Community Content

If you participate in community features (forums, leaderboards), you:

• Are responsible for content you post
• Grant us a license to display your public posts
• Agree not to post inappropriate, offensive, or illegal content
• Understand we may remove content that violates our guidelines

7. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Share your account credentials with others
• Attempt to reverse engineer, hack, or exploit the App
• Upload malicious content, viruses, or harmful code
• Harass, bully, or harm other users in community features
• Impersonate others or misrepresent your identity
• Use automated systems to access the App (bots, scrapers)
• Circumvent any access restrictions or usage limits
• Redistribute or resell App content without permission

8. Intellectual Property

The App and its content, including but not limited to:

• Video tutorials and written guides
• AI models and analysis algorithms
• User interface and design elements
• Trademarks, logos, and branding
• Software code and technology

are owned by Fairway Fundamentals and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Disclaimers and Limitations

No Guarantee of Results

We do not guarantee that using the App will improve your golf game, lower your handicap, or produce any specific results. Golf improvement depends on many factors beyond our control.

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not responsible for injuries sustained while following AI suggestions or tutorial guidance
• We are not liable for loss of data, although we make reasonable efforts to protect it

10. Indemnification

You agree to indemnify and hold harmless Fairway Fundamentals, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or share through the App

11. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse community features or harass other users
• Attempt to circumvent subscription restrictions

You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases, but these Terms continue to apply to any prior use.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through:

• In-app notifications
• Updated "Last updated" date
• Email notification for significant changes

Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You agree to waive any right to participate in class action lawsuits against us.
