1. Acceptance of Terms

By accessing or using AutoRescue, you agree to be bound by these Terms of Service. If you do not agree, please do not use the app.

2. Description of Service

AutoRescue is a mobile application that connects users with roadside assistance service providers. Services include towing, battery jump starts, flat tire assistance, fuel delivery, and lockout services. The service is available in free (pay-per-use) and premium (subscription) versions.

3. Account Registration

• You must create an account to use AutoRescue
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account
• You must be at least 18 years old to use AutoRescue
• You agree to notify us immediately of any unauthorized account use
• One account per person; no shared accounts

You agree to:

• Provide accurate location information when requesting service
• Be present with your vehicle when service arrives
• Provide accurate vehicle information
• Treat service providers with respect
• Pay for services as agreed
• Not misuse or abuse the service

7. User Conduct

You agree NOT to:

• Use the service for illegal purposes
• Submit false or fraudulent service requests
• Harass or threaten service providers
• Attempt to hack, disrupt, or damage the service
• Create multiple accounts to abuse features or promotions
• Share your account with others
• Resell or commercially exploit the service

8. Independent Service Providers

• Service providers are independent contractors, not employees of AutoRescue
• AutoRescue screens and monitors service providers
• We are not responsible for the actions of service providers
• Service quality issues should be reported through the app
• We may remove providers who receive poor ratings

9. Safety

• In an emergency, always call 911 first
• Move to a safe location if possible before requesting service
• AutoRescue is not a substitute for emergency services
• Turn on hazard lights and stay visible
• Stay in your vehicle if conditions are unsafe

10. Disclaimer of Warranties

AutoRescue is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose
• Guaranteed response times
• Uninterrupted or error-free service
• Availability in all locations
• Quality of service provider work

11. Limitation of Liability

AutoRescue and its owners shall not be liable for:

• Indirect, incidental, or consequential damages
• Lost profits or data
• Vehicle damage caused by service providers
• Delays in service
• Service provider negligence
• Maximum liability limited to amount paid in past 12 months

12. Indemnification

You agree to indemnify and hold harmless AutoRescue from any claims, losses, or damages arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

13. Termination

• We may suspend or terminate your account for violations of these Terms
• Fraudulent activity will result in immediate termination
• You may delete your account at any time through app settings
• Upon termination, your right to use the service ceases immediately
• Premium subscription refunds subject to our refund policy

14. Changes to Terms

• We reserve the right to modify these Terms at any time
• Continued use after changes constitutes acceptance
• Material changes will be communicated through the app
• Last updated date will be revised accordingly

15. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

16. Apple App Store Terms

• Subscriptions are purchased through Apple In-App Purchase
• Apple is not responsible for the app or these Terms
• You agree to Apple's Licensed Application End User License Agreement
• In case of conflict, Apple's terms take precedence regarding payment

17. Dispute Resolution

• Any disputes will be resolved through binding arbitration
• You waive the right to participate in class action lawsuits
• Small claims court remains an option for qualifying disputes
• Arbitration will be conducted in English in a mutually agreed location

18. Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and AutoRescue regarding use of the service.
