1. Acceptance of Terms

Welcome to StoryStream, operated by Pelton Apps. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pelton Apps ("we," "us," or "our") governing your use of the StoryStream mobile application.

By downloading, installing, accessing, or using StoryStream, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the app.

You must be at least 13 years of age to use StoryStream. If you are under 18, you must have permission from a parent or legal guardian.

2. Account Responsibilities

As a StoryStream user, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with others
  • Not create multiple accounts for abusive purposes
  • Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

3. Subscription Terms

Subscription Tiers:

  • Free: 10 saved books, 3 communities, standard streams (with ads)
  • Premium ($9.99/month): Unlimited library, unlimited communities, ad-free, HD streams, offline downloads, custom AI themes
  • Elite ($19.99/month): Everything in Premium plus exclusive author sessions, AI character interactions, VR-ready experience, priority support

Payment and Billing:

  • All payments are processed through the Apple App Store
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Prices are in U.S. Dollars and may vary by region
  • All sales are final except as required by applicable law

Auto-Renewal:

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • The renewal cost will be the same as the initial subscription price unless otherwise notified

Cancellation:

  • You may cancel your subscription at any time through your Apple ID Account Settings
  • Cancellation takes effect at the end of the current billing period
  • You will retain access to premium features until the end of your paid period
  • No refunds are provided for partial subscription periods
  • All refund requests must be submitted through Apple

Free Trials:

  • We may offer free trial periods for premium subscriptions
  • You must cancel before the trial ends to avoid being charged
  • Unused portions of a free trial are forfeited when purchasing a subscription

4. Acceptable Use

You agree to use StoryStream only for lawful purposes. You may NOT:

  • Use the app for any illegal purpose or in violation of any laws
  • Attempt to hack, disrupt, or interfere with the app or its servers
  • Reverse engineer, decompile, or disassemble the app
  • Copy, modify, or create derivative works of the app
  • Use automated systems or bots to access the app
  • Scrape or harvest content or user data
  • Circumvent subscription limitations or access controls
  • Share, redistribute, or commercially exploit app content
  • Impersonate others or misrepresent your identity
  • Use the app to send spam or unsolicited communications

5. Content Guidelines for Communities and Chat

When participating in communities or live stream chats, you agree NOT to post content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Contains hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Is sexually explicit, obscene, or pornographic
  • Promotes violence, terrorism, or dangerous activities
  • Contains personal attacks or bullying
  • Shares personal information of others without consent
  • Is spam, advertising, or promotional in nature
  • Infringes on intellectual property rights
  • Contains spoilers without proper warnings
  • Is off-topic or disruptive to community discussions

We reserve the right to remove any content that violates these guidelines and to suspend or terminate accounts of repeat offenders. You can report inappropriate content using the in-app reporting feature.

6. Intellectual Property

Our Rights:

StoryStream and all its content, features, and functionality (including but not limited to the app design, software code, AI narration technology, stream visuals, user interface, text, graphics, logos, and trademarks) are owned by Pelton Apps or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Book Content:

Books featured in StoryStream are either in the public domain or licensed for use. Copyright for each book remains with its respective rights holders. StoryStream's presentation format (AI narration, visuals, stream formatting) is proprietary.

Your Content:

You retain ownership of content you create (posts, comments, chat messages). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within StoryStream for the purpose of operating and improving the service.

Trademarks:

"StoryStream" and the StoryStream logo are trademarks of Pelton Apps. You may not use these trademarks without our prior written permission.

7. Disclaimer of Warranties

STORYSTREAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:

  • Warranties of merchantability or fitness for a particular purpose
  • That the app will be uninterrupted, secure, or error-free
  • That defects will be corrected
  • That the app is free of viruses or harmful components
  • The accuracy, reliability, or completeness of any content
  • Continuous availability of any particular stream or content

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PELTON APPS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or use
  • Any damages resulting from use of or inability to use the app
  • Any content posted by users in communities or chat
  • Any third-party conduct or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Pelton Apps, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of StoryStream, your violation of these Terms, your content, or your violation of any rights of another party.

10. Termination

By You:

You may terminate your account at any time by going to Profile > Settings > Account > Delete Account. Remember to cancel any active subscriptions through Apple before deleting your account.

By Us:

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms or our Community Guidelines
  • Engage in fraudulent or abusive activity
  • Harass other users or our staff
  • Post prohibited content repeatedly

Effect of Termination:

Upon termination, your right to use StoryStream immediately ceases. Your data will be handled according to our Privacy Policy. Subscription refunds are not provided for accounts terminated due to Terms violations.

11. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the United States, without regard to conflict of law principles
  • Any disputes arising from these Terms or your use of StoryStream shall be resolved through binding arbitration
  • You agree to waive your right to participate in class action lawsuits
  • Small claims court remains an option for qualifying disputes

12. Apple App Store Terms

Your use of StoryStream is also subject to Apple's App Store Terms of Service. You acknowledge that:

  • These Terms are between you and Pelton Apps, not Apple
  • Apple has no obligation to provide maintenance or support for StoryStream
  • Apple is not responsible for any claims, losses, or damages relating to the app
  • Apple is a third-party beneficiary of these Terms
  • All refund requests must be submitted through Apple
  • In case of conflict regarding payments, Apple's terms take precedence

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app, sending an email notification, or displaying a prominent in-app notice. Your continued use of StoryStream after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the app.

14. General Provisions

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pelton Apps regarding StoryStream
  • No Waiver: Our failure to enforce any right or provision does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction
