Agreement to Terms
By downloading, installing, or using the Somnara mobile application ("Somnara" or "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Somnara is operated by SketchMyApp LLC ("we," "us," or "our").
Service Description
Somnara is a sleep optimization application that provides:
- Circadian rhythm assessment and scoring
- Personalized sleep timing recommendations
- Guided breathing exercises for sleep
- Sleep logging and analytics
- Daily insights and coaching tips
- Sleep product recommendations
Important Disclaimer: Somnara provides general sleep and wellness information and is not a substitute for professional medical advice, diagnosis, or treatment. If you have a sleep disorder or medical condition, consult your healthcare provider.
Eligibility
You must be at least 13 years old to use Somnara. By using the App, you represent that you meet this age requirement. If you are under 18, you should use the App under parental or guardian supervision.
Account Responsibilities
When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
Subscriptions and Payments
Free Features
Somnara offers free features including the circadian assessment, basic sleep logging, 4-7-8 breathing exercise, and daily insights.
Premium Subscription
Premium features are available through auto-renewable subscriptions:
- Monthly: $9.99 USD per month
- Yearly: $79.99 USD per year
Billing
Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Cancellation
You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Use automated systems to access the App
- Share your account credentials with others
Intellectual Property
All content, features, and functionality of Somnara are owned by SketchMyApp LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
SLEEP INFORMATION PROVIDED IS FOR GENERAL GUIDANCE ONLY. WE MAKE NO GUARANTEES REGARDING HEALTH OUTCOMES FROM FOLLOWING APP RECOMMENDATIONS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHMYAPP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
