Terms of Service

Agreement to Terms

By downloading, installing, or using the SleepyStars mobile application ("SleepyStars" or "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. SleepyStars is operated by SketchMyApp LLC ("we," "us," or "our").

Service Description

SleepyStars is a children's bedtime routine application that provides:

• Gamified bedtime routine tracking with customizable tasks
• A star-based reward system for completing bedtime activities
• Virtual pet companions that kids care for using earned stars
• Progress reports and analytics for parents
• Avatar and room customization

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use SleepyStars. Child profiles may only be created and managed by a parent or legal guardian. By creating a child profile, you represent that you are the child's parent or legal guardian.

Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Supervise your child's use of the App
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Subscriptions and Payments

Virtual Currency (Stars)

Stars are a virtual currency within SleepyStars used to unlock rewards, care for virtual pets, and customize the app experience. Stars have no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash. We reserve the right to modify the star economy, pricing, and reward structure at any time.

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the App
• Share your account credentials with others
• Exploit bugs or glitches to gain unfair advantages in the star system

Intellectual Property

All content, features, and functionality of SleepyStars -- including but not limited to text, graphics, logos, icons, virtual pet designs, animations, and software -- are owned by SketchMyApp LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

SLEEPYSTARS IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. THE APP IS INTENDED AS A FUN TOOL TO HELP ESTABLISH BEDTIME ROUTINES AND SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL SLEEP OR BEHAVIORAL GUIDANCE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHMYAPP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless SketchMyApp LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the App and contacting us to remove your data.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
