Agreement to Terms

By downloading, installing, or using the ScoreCast mobile application ("ScoreCast" or "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. ScoreCast is operated by SketchMyApp LLC ("we," "us," or "our").

Service Description

ScoreCast is an AI-powered NFL game prediction application that provides:

  • Monte Carlo simulations for NFL game outcomes
  • Betting edge analysis using real sportsbook odds
  • Player projection reports based on real ESPN data
  • Play-by-play game simulations
  • Historical prediction tracking and accuracy metrics

Important Disclaimer: ScoreCast provides game predictions and analysis for entertainment and informational purposes only. Predictions are NOT financial advice and should NOT be relied upon for making betting or wagering decisions. We do not guarantee the accuracy of any prediction, simulation, or analysis. You are solely responsible for any decisions you make based on information provided by the App. Past prediction accuracy does not guarantee future results.

No Gambling Services

ScoreCast does not offer, facilitate, or enable gambling, wagering, or betting of any kind. The App does not accept bets, process wagers, or connect users with sportsbooks or gambling operators. Betting edge analysis and odds data are provided purely for informational and entertainment purposes. You must comply with all applicable local, state, and federal laws regarding sports betting in your jurisdiction.

Eligibility

You must be at least 17 years old to use ScoreCast. By using the App, you represent that you meet this age requirement. The App contains references to betting odds and sports wagering concepts intended for adult audiences only.

Account Responsibilities

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Subscriptions and Payments

Free Features

ScoreCast offers free features including up to 5 game simulations per week, basic prediction results, and limited player projections.

Pro Subscription

Pro features are available through auto-renewable subscriptions:

  • Monthly: $9.99 USD per month
  • Yearly: $99.99 USD per year

Billing

Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems to access the App or scrape data
  • Share your account credentials with others
  • Redistribute, resell, or commercially exploit prediction data from the App

Intellectual Property

All content, features, and functionality of ScoreCast—including but not limited to text, graphics, logos, icons, simulation algorithms, and software—are owned by SketchMyApp LLC and are protected by copyright, trademark, and other intellectual property laws. NFL team names, logos, and related marks are trademarks of the National Football League and its member teams.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

ALL PREDICTIONS, SIMULATIONS, ODDS ANALYSIS, AND PLAYER PROJECTIONS ARE PROVIDED FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY. WE MAKE NO GUARANTEES REGARDING THE ACCURACY OF ANY PREDICTION OR ANALYSIS. PAST PERFORMANCE AND PREDICTION ACCURACY DO NOT GUARANTEE FUTURE RESULTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHMYAPP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR FINANCIAL LOSSES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY PREDICTIONS OR ANALYSIS PROVIDED BY THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless SketchMyApp LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your reliance on predictions or analysis, or your violation of these Terms.

Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the App and contacting us to remove your data.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
