Terms of Service

Agreement to Terms

By downloading, installing, or using the ProximityPerks mobile application ("ProximityPerks" or "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. ProximityPerks is operated by SketchMyApp LLC ("we," "us," or "our").

Service Description

ProximityPerks is a home services marketplace application that provides:

  • A platform to discover and book local home service providers
  • Chain discount functionality for group bookings among neighbors
  • Real-time messaging between homeowners and service providers
  • Scheduling and calendar management tools
  • Reviews, ratings, and business analytics

Important: ProximityPerks is a marketplace platform that connects homeowners with independent service providers. We do not employ, endorse, or guarantee the work of any service provider listed on the platform. Service providers are independent businesses responsible for the quality and safety of their work.

Eligibility

You must be at least 18 years old to use ProximityPerks. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Types and Responsibilities

Homeowner Accounts

As a homeowner, you agree to:

  • Provide accurate contact and service address information
  • Maintain the security of your account credentials
  • Submit honest and fair reviews of service providers
  • Honor bookings or cancel with reasonable notice
  • Communicate respectfully with service providers

Service Provider Accounts

As a service provider, you agree to:

  • Provide accurate business information and credentials
  • Maintain appropriate licenses and insurance for your trade
  • Honor confirmed bookings and pricing
  • Perform services in a professional and safe manner
  • Respond to customer messages and booking requests in a timely fashion
  • Comply with all applicable local, state, and federal regulations

Chain Discounts

Chain discounts are subject to the following terms:

  • Discount amounts are determined by the service provider and the number of participants in the chain
  • Chain discounts are not guaranteed until the chain closes and bookings are confirmed
  • If a participant cancels, the discount for remaining participants may be adjusted
  • ProximityPerks facilitates the chain discount but does not set or guarantee specific discount amounts
  • Chain discount eligibility is based on geographic proximity and service provider availability

Subscriptions and Payments

Free Features

ProximityPerks offers free features including provider search, basic booking, chain discount participation, messaging, and reviews.

Premium Subscription

Premium features may be available through auto-renewable subscriptions. Pricing and included features are displayed in the app at the time of purchase.

Billing

Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Service Payments

Payment for home services is arranged directly between the homeowner and the service provider. ProximityPerks does not process payments for services rendered and is not responsible for payment disputes between users.

Reviews and User Content

When you submit reviews, ratings, photos, or other content through the App, you agree that:

  • Your content is truthful and based on genuine experience
  • You will not submit fraudulent, defamatory, or misleading reviews
  • You grant SketchMyApp LLC a non-exclusive, royalty-free license to display your content within the App
  • We reserve the right to remove content that violates these Terms or community standards

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems to access the App
  • Share your account credentials with others
  • Harass, threaten, or abuse other users through the messaging system
  • Submit false reviews or manipulate ratings
  • Misrepresent your identity, qualifications, or business credentials

Intellectual Property

All content, features, and functionality of ProximityPerks -- including but not limited to text, graphics, logos, icons, and software -- are owned by SketchMyApp LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business purposes as intended.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY SERVICE PROVIDERS ON THE PLATFORM. WE DO NOT VERIFY THE ACCURACY OF LISTINGS OR THE QUALIFICATIONS OF SERVICE PROVIDERS BEYOND OUR STATED VERIFICATION PROCESS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHMYAPP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE APP OR SERVICES BOOKED THROUGH THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless SketchMyApp LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, services you provide or receive through the platform, or violation of these Terms.

Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the App and contacting us to remove your data. Upon termination, any pending bookings may be canceled, and chain discount participation will end.

Dispute Resolution

Disputes between homeowners and service providers regarding the quality, pricing, or completion of services should be resolved directly between the parties. ProximityPerks may, at its sole discretion, assist with mediation but is not obligated to resolve user disputes.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
