Agreement to Terms

By downloading, installing, or using the PropScout mobile application ("PropScout" or "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. PropScout is operated by SketchMyApp LLC ("we," "us," or "our").

Service Description

PropScout is a real estate investment research application that provides:

• AI-powered natural language property search
• Investment analysis tools (ROI, cap rate, cash flow projections)
• Location-based property discovery with GPS auto-detect
• Property watchlist and tracking features
• Market insights dashboard and portfolio tracking
• Real estate listing data sourced from third-party providers

Data Accuracy and Limitations

Property listings, market data, valuations, and investment projections displayed in PropScout are sourced from third-party data providers and public records. While we strive for accuracy:

• Property data may be outdated, incomplete, or inaccurate
• Listing availability and pricing may change without notice
• Investment projections (ROI, cap rate, cash flow) are estimates based on assumptions that may not reflect actual market conditions
• Market insights are for informational purposes and do not predict future performance
• We do not guarantee the accuracy, completeness, or timeliness of any data displayed in the App

You are solely responsible for verifying all property information, conducting your own due diligence, and consulting qualified professionals before making any real estate investment decisions.

Eligibility

You must be at least 18 years old to use PropScout. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Subscriptions and Payments

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to scrape or harvest data from the App
• Share your account credentials with others
• Redistribute, resell, or commercially exploit property data obtained through the App

Intellectual Property

All content, features, and functionality of PropScout—including but not limited to text, graphics, logos, icons, analysis tools, and software—are owned by SketchMyApp LLC and are protected by copyright, trademark, and other intellectual property laws. Property listing data is provided by third-party sources and remains the intellectual property of those providers.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

PROPERTY DATA, INVESTMENT PROJECTIONS, AND MARKET ANALYSIS PROVIDED ARE FOR INFORMATIONAL PURPOSES ONLY. WE MAKE NO GUARANTEES REGARDING THE ACCURACY OF PROPERTY DATA, INVESTMENT RETURNS, OR FINANCIAL OUTCOMES FROM USING THE APP. PAST MARKET PERFORMANCE DOES NOT GUARANTEE FUTURE RESULTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHMYAPP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, INVESTMENT LOSSES, OR DATA LOSS, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY DATA OR ANALYSIS PROVIDED BY THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless SketchMyApp LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, reliance on data provided by the App, or violation of these Terms.

Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the App and contacting us to remove your data.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
