By accessing or using Fruit Tree Treasury, you agree to be bound by these Terms of Service. If you don't agree, please don't use our app.
Description of Service
Fruit Tree Treasury connects users with real fruit trees in partner orchards. Users can:
Key Terms Explained
"Real Tree"
An actual, physical fruit tree located in a partner orchard
"Ownership"
Fractional ownership rights entitling you to harvest allocations (not land ownership)
"Credits"
Account balance used to purchase trees ($1 credit = $1 USD)
"Orchard Partner"
Certified farms that host and maintain trees
Account Requirements
- •Must be 18+ years old
- •Provide accurate information
- •Maintain account security
- •One account per person
- •You're responsible for all activity under your account
Tree Ownership Terms
Fractional Ownership
- •Multiple users can own shares of one tree (up to maximum set by orchard)
- •Ownership lasts for the life of the tree
- •You receive harvest allocations proportional to your share
- •You do NOT own the land or the tree itself (orchard partner retains legal ownership)

- • Monthly growth updates and photos
- • Share of harvest when tree produces fruit
- • Access to care schedules and tree data
- • Ability to visit your tree (by appointment)
✗What You Don't Get
- • Guaranteed harvest amounts
- • Control over tree care decisions
- • Land ownership rights
- • Ability to remove or relocate the tree
Purchases and Payments
Adding Funds
- • Add funds to your account via Apple In-App Purchases
- • Credits never expire and are tied to your account
- • Non-refundable once added (but can be used for any tree purchase)
Tree Purchases
- • Tree prices set by individual orchard partners
- • Purchases are final once completed
- • If a tree dies or is removed before maturity, you'll receive a replacement tree credit
Premium Subscription
- • Auto-renewable subscription ($9.99/month or $99.99/year)
- • Provides access to rare species, advanced analytics, and premium features
- • Cancel anytime (no refunds for partial months)
- • Manage via App Store subscription settings

Harvest Terms

Prohibited Uses
You may NOT:
- ✗Use the app for any illegal purpose
- ✗Attempt to access other users' accounts
- ✗Interfere with app functionality
- ✗Resell trees or transfer ownership without permission
- ✗Harass orchard partners or staff
- ✗Violate orchard property rules during visits
Intellectual Property
- ©App content, photos, and design are owned by Fruit Tree Treasury or licensed
- 📸Tree photos are provided by orchard partners
- ⚖️You may not reproduce or redistribute app content without permission
Disclaimers
⚠️No Guarantee of Harvest
Fruit trees are living organisms subject to weather, disease, pests, and natural cycles. We cannot guarantee specific harvest amounts or quality.
👨🌾Orchard Partner Responsibility
Tree care is managed by certified orchard partners. We are not liable for their actions, though we vet all partners carefully.
📱App Availability
We strive for 99% uptime but cannot guarantee uninterrupted service.
Limitation of Liability
To the maximum extent permitted by law, Fruit Tree Treasury is not liable for:
- • Lost profits or indirect damages
- • Harvest failures due to natural causes
- • Data loss or app downtime
- • Actions of orchard partners
Our total liability shall not exceed the amount you paid for credits in the past 12 months.
Termination
We may suspend or terminate accounts that violate these terms. You may delete your account at any time via app settings. Upon termination, your tree ownerships may be transferred to partner orchards for donation.
Changes to Terms
We may modify these terms with notice. Continued use after changes constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of [Your State/Country]. Any disputes will be resolved in the courts of [Your Jurisdiction].
