1. Acceptance of Terms

Welcome to Faith & Fitness Daily. These Terms of Use and End User License Agreement ("Terms") constitute a legally binding agreement between you and Faith & Fitness Daily governing your use of our mobile application.

By downloading, installing, accessing, or using the Faith & Fitness Daily app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the app.

You must be at least 13 years of age to use this app. If you are under 18, you must have permission from a parent or legal guardian.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the app on devices that you own or control
  • Access and use the app for your personal, non-commercial purposes

License Restrictions:

You may NOT:

  • Copy, modify, or create derivative works of the app
  • Reverse engineer, decompile, or disassemble the app
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the app for any commercial purpose or public display
  • Distribute, sublicense, rent, lease, or lend the app
  • Use the app in any way that violates applicable laws or regulations

3. Subscription Terms

Subscription Options:

  • Free Tier: Access to Runner program, basic tracking, and daily Bible verse
  • Monthly Premium: $9.99/month - Access to all features and programs
  • Annual Premium: $69.99/year - Access to all features and programs (Save 42%)

Payment and Billing:

  • All payments are processed through the Apple App Store
  • Payment will be charged to your iTunes Account at confirmation of purchase
  • Prices are in U.S. Dollars and may vary by region
  • All sales are final; we do not offer refunds except as required by law

Auto-Renewal:

  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings

Cancellation:

  • You may cancel your subscription at any time through your Apple ID settings
  • Cancellation takes effect at the end of the current billing period
  • You will continue to have access to Premium features until the end of your paid period
  • No partial refunds for unused portions of a subscription period

4. User Responsibilities

As a user of Faith & Fitness Daily, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Use the app in compliance with all applicable laws and regulations
  • Respect the rights of other users and our staff
  • Not share your account credentials with others
  • Not use the app for any unlawful or prohibited purposes

5. Health and Fitness Disclaimer

IMPORTANT HEALTH WARNING: Before beginning any exercise program, you should consult with your physician or healthcare provider, especially if you:

  • Have any chronic health conditions or injuries
  • Are taking any medications
  • Are pregnant or may become pregnant
  • Have a history of heart disease or high blood pressure
  • Have any concerns about your ability to safely exercise

Faith & Fitness Daily is NOT a medical service and does not provide medical advice, diagnosis, or treatment. The workout programs, exercise recommendations, and health-related content are for informational and educational purposes only.

You acknowledge that physical exercise involves inherent risks of injury. You assume full responsibility for any injuries or health problems that may result from use of the app. Stop exercising immediately if you experience pain, dizziness, or discomfort.

6. Faith-Based Content & ESV Bible Attribution

Faith & Fitness Daily is a Christian faith-based app that incorporates Biblical content and faith principles. By using the app, you acknowledge and accept its faith-based nature.

Premium members have access to additional Bible translations, each subject to their respective copyright holders and permissions.

7. Intellectual Property

All content, features, and functionality of the app, including but not limited to workout programs, exercise descriptions, software code, user interface design, graphics, text, images, and trademarks are owned by Faith & Fitness Daily or our licensors and are protected by copyright, trademark, and other intellectual property laws.

"Faith & Fitness Daily" and our logo are trademarks of Faith & Fitness Daily. You may not use these trademarks without our prior written permission.

8. Apple HealthKit Integration

If you choose to integrate with Apple HealthKit:

  • You grant permission for the app to read and write specific health data
  • HealthKit data is stored locally on your device and encrypted by iOS
  • We do not upload HealthKit data to our servers
  • HealthKit data is never shared with third parties
  • HealthKit data is never used for advertising

You maintain complete control over HealthKit permissions and can revoke access at any time through iOS Settings.

9. Termination

You may terminate your account at any time by deleting your account in the app settings or contacting support. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse other users.

Upon termination, your right to use the app immediately ceases, and your data may be deleted in accordance with our Privacy Policy.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:

  • Warranties of merchantability or fitness for a particular purpose
  • That the app will be uninterrupted, secure, or error-free
  • That defects will be corrected
  • That the app is free of viruses or harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAITH & FITNESS DAILY SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or use
  • Any personal injury or property damage
  • Any damages resulting from use of or inability to use the app

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

12. Dispute Resolution

  • These Terms shall be governed by the laws of the United States
  • Any disputes will be resolved through binding arbitration
  • You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class action

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or sending an email notification. Your continued use of the app after changes become effective constitutes acceptance of the revised Terms.

14. App Store Terms

Your use of the app is also subject to Apple's App Store Terms of Service. You acknowledge that:

  • These Terms are between you and Faith & Fitness Daily, not Apple
  • Apple has no obligation to provide maintenance or support for the app
  • Apple is not responsible for any claims, losses, or damages relating to the app
  • All refund requests must be made through Apple according to their refund policies
