1. Acceptance of Terms

By downloading, installing, or using ChordMaster AI ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and JP Elton ("we," "our," or "us").

2. Description of Service

ChordMaster AI is a mobile application that uses artificial intelligence to analyze audio and detect musical elements including chord progressions, key signatures, tempo, and song structure. The App allows users to record audio, upload audio files, and save analyzed songs to a personal library.

3. Account Registration

Some features require account creation. You agree to provide accurate information and maintain the security of your account credentials. You are responsible for all activities under your account. You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

4. Subscription Terms

ChordMaster AI offers free and paid subscription options:

  • Free: Limited daily analyses, 30-second recordings, basic features
  • Pro Monthly: $9.99/month - Unlimited analyses, 10-minute recordings, all features
  • Pro Yearly: $79.99/year - Same as monthly with 33% savings

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Manage subscriptions in your Apple ID settings. No refunds for partial subscription periods.

5. User Content

You retain ownership of any audio content you record or upload ("User Content"). By using the App, you grant us a limited license to process your User Content solely for providing the chord analysis service. You represent that you have the right to use any audio you submit and that it does not violate any third-party rights.

6. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Upload content that infringes intellectual property rights
  • Attempt to reverse engineer, decompile, or hack the App
  • Use automated systems to access the App excessively
  • Resell or redistribute the App or its analysis results commercially
  • Interfere with or disrupt the App's operation

7. Intellectual Property

The App, including its code, design, AI algorithms, and content, is owned by JP Elton and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App except as permitted by these Terms. The ChordMaster AI name and logo are trademarks of JP Elton.

8. Accuracy Disclaimer

While we strive for accurate chord detection, AI analysis may not always be 100% accurate. Results depend on audio quality, complexity, and other factors. The App is intended as a learning aid and should not be relied upon for professional transcription or licensing purposes.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JP ELTON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless JP Elton from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by deleting your account in the App settings. Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the App.

14. Apple App Store Terms

The following terms apply to App Store distribution:

  • These Terms are between you and JP Elton, not Apple
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for any claims related to the App
  • Apple is a third-party beneficiary of these Terms
  • You must comply with Apple's App Store Terms of Service

15. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.

16. Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us at support@sketchmyapp.com. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JP Elton regarding the App. Any prior agreements or communications are superseded.
