1. Acceptance of Terms

By downloading, accessing, or using ChordCraft, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Description of Service

ChordCraft is a mobile songwriting application available for iOS and Android that provides AI-powered chord detection, lyric transcription, song editing, and organization tools. The service is available in both free and Pro (paid subscription) versions.

3. Account Registration

• You must create an account to use ChordCraft
• You may sign up with email or use Apple/Google sign-in
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to use ChordCraft
• You agree to notify us immediately of any unauthorized account access
• You are responsible for all activity that occurs under your account

5. User Content and Ownership

• You retain full ownership and copyright of all songs, lyrics, and recordings you create
• ChordCraft does NOT claim any ownership rights to your musical content
• You grant ChordCraft a limited license to store, process, and display your content to provide the service
• When you share songs publicly, you grant other users the right to view and access them
• When you collaborate, you grant collaborators the right to edit shared songs
• You are solely responsible for your content and any consequences of posting or sharing it
• You represent that you have all necessary rights to the content you upload

6. User Conduct

You agree NOT to:

• Use the app for any illegal purpose or in violation of any laws
• Upload content that infringes on others' copyright or intellectual property
• Share inappropriate, offensive, or harmful content
• Attempt to hack, reverse engineer, or disrupt the service
• Create multiple accounts to abuse features
• Share your account credentials with others
• Use automated tools, bots, or scrapers to access the app
• Spam other users or abuse collaboration features
• Circumvent payment systems or subscription restrictions
• Impersonate another person or entity

7. Audio Recording and Processing

• ChordCraft requires microphone access to record audio for chord detection and transcription
• Audio recordings are processed using AI to detect chords and transcribe lyrics
• Recordings are temporarily stored during processing and then deleted
• Processed data (chords and lyrics) is stored in your account
• You are responsible for ensuring you have rights to record and upload any audio content
• ChordCraft is not liable for copyright infringement related to user recordings

8. Intellectual Property

• All ChordCraft app content, features, code, and functionality are owned by ChordCraft
• You may not copy, modify, distribute, or reverse engineer the app
• The ChordCraft name, logo, and branding are trademarks
• Your songs, lyrics, and recordings remain your property (see Section 5)
• Feedback or suggestions you provide may be used by ChordCraft without compensation

9. AI and Technology Limitations

• Chord detection and lyric transcription are powered by AI and may not be 100% accurate
• Results depend on audio quality, recording conditions, and instrument tuning
• We do not guarantee perfect chord detection or transcription
• AI arrangement suggestions are provided "as is" without guarantees
• You are responsible for reviewing and correcting AI-generated content
• Pro features may provide improved accuracy but are not error-free

10. Collaboration Features (Pro Only)

• Real-time collaboration allows multiple users to edit songs simultaneously
• You are responsible for managing collaboration permissions
• Collaborators you invite will have edit access to shared songs
• You may revoke collaboration access at any time
• We are not responsible for disputes between collaborators
• Collaboration data is synced through our servers

11. Community and Sharing

• You may share songs publicly with the ChordCraft community
• Shared songs are visible to all users
• We reserve the right to remove inappropriate or infringing content
• You are responsible for any copyright issues related to shared content
• We do not endorse or verify user-shared content
• Users may report inappropriate content

12. Disclaimer of Warranties

ChordCraft is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement
• Uninterrupted, secure, or error-free service
• Accuracy or reliability of chord detection or transcription
• Compatibility with all devices or operating systems
• Prevention of data loss

13. Limitation of Liability

ChordCraft and its owners, employees, and affiliates shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, songs, recordings, or content
• Loss of profits, revenue, or business opportunities
• Service interruptions or downtime
• Third-party actions or content
• Copyright infringement claims related to user content
• Inaccurate chord detection or transcription
• Maximum liability limited to amount paid in the past 12 months (or $100 if no payments)

14. Indemnification

You agree to indemnify and hold harmless ChordCraft from any claims, damages, losses, or expenses (including legal fees) arising from your use of the app, your content, your violation of these Terms, or your infringement of any third-party rights.

15. Data Backup

• We strive to protect your data but are not responsible for data loss
• You should regularly backup important songs by exporting to PDF (Pro) or other methods
• We recommend keeping local copies of important work
• Cloud sync is a convenience feature, not a guaranteed backup service

16. Termination

• We may suspend or terminate your account for violations of these Terms
• We may terminate accounts for prolonged inactivity
• You may delete your account at any time through app settings
• Upon termination, your right to use the service ceases immediately
• Your subscription will not be refunded upon termination for violations
• Provisions regarding intellectual property, liability, and indemnification survive termination
• We may retain some data as required by law after account deletion

17. Changes to Terms or Service

• We reserve the right to modify these Terms at any time
• We may add, remove, or modify features at our discretion
• Continued use after changes constitutes acceptance
• Material changes will be communicated through the app or email
• Last updated date will be revised accordingly
• Subscription pricing changes will be communicated with advance notice

18. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts in the United States for any disputes.

20. Dispute Resolution

• Any disputes will be resolved through binding arbitration
• You waive the right to participate in class action lawsuits
• Arbitration will be conducted under the American Arbitration Association rules
• Small claims court remains an option for qualifying disputes under $10,000
• Each party bears their own costs unless otherwise awarded

21. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect and a valid provision that most closely matches the intent will be substituted.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChordCraft regarding use of the service and supersede all prior agreements.
