1. Agreement to Terms

By downloading, accessing, or using AlbaRide ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. These Terms constitute a legally binding agreement between you and SketchMyApp LLC ("Company," "we," "us," or "our").

2. Description of Service

AlbaRide is a ridesharing platform that connects drivers with available seats in their vehicles to passengers traveling in the same direction. The App facilitates cost-sharing arrangements between community members.

3. Eligibility

To use AlbaRide, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the App under applicable laws
• Provide accurate and complete registration information

Additionally, to offer rides as a driver, you must:

• Hold a valid driver's license
• Have valid vehicle registration and insurance
• Complete our driver verification process
• Meet all local legal requirements for driving

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Not share your account with others
• Not create multiple accounts

5. User Conduct

When using AlbaRide, you agree to:

• Treat all users with respect and courtesy
• Be punctual for scheduled pickups
• Communicate clearly about ride details
• Honor agreed-upon cost-sharing arrangements
• Follow all applicable traffic laws and regulations
• Maintain a safe and clean vehicle (for drivers)

You agree NOT to:

• Use the App for commercial transportation services
• Charge more than a fair share of actual trip costs
• Harass, threaten, or discriminate against other users
• Provide false or misleading information
• Use the App while impaired by alcohol or drugs
• Carry illegal substances or contraband
• Engage in any illegal activity
• Attempt to circumvent the App's features or security
• Use automated tools or bots to access the App

6. Rides and Cost Sharing

AlbaRide facilitates cost-sharing, not commercial transportation:

• Cost sharing only: Drivers may only request contributions toward actual trip costs (fuel, tolls, parking)
• No profit: Drivers may not charge amounts exceeding actual costs or seek to profit from rides
• Direct arrangement: Payment terms are arranged directly between users
• User responsibility: Users are responsible for settling payments as agreed

AlbaRide does not process payments between users and is not responsible for payment disputes.

8. Driver Responsibilities

If you offer rides through AlbaRide, you acknowledge and agree that:

• You are solely responsible for your driving and vehicle
• You will maintain valid insurance coverage
• You will comply with all traffic laws and regulations
• You will not drive while impaired
• You will maintain your vehicle in safe operating condition
• You are responsible for your passengers' safety during the ride
• You will accurately represent your ride details
• You understand that AlbaRide does not provide insurance coverage

10. Intellectual Property

The App and its original content, features, and functionality are owned by SketchMyApp LLC and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use our trademarks without permission
• Create derivative works based on the App

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Conduct that may harm other users or the community
• Fraudulent or illegal activity
• Extended inactivity
• At our sole discretion

You may terminate your account at any time by deleting your account through the App settings or contacting support.

You agree to indemnify, defend, and hold harmless SketchMyApp LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your conduct during rides
• Any content you submit to the App

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or in-app notification. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SketchMyApp LLC regarding your use of the App and supersede all prior agreements and understandings.
