Terms of Service

Agreement to Terms

By downloading, installing, or using the WanderSmart mobile application ("WanderSmart" or "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. WanderSmart is operated by SketchMyApp LLC ("we," "us," or "our").

Service Description

WanderSmart is a comprehensive travel companion application that provides:

  • GPS navigation and turn-by-turn directions
  • Weather forecasts for your destinations
  • Real-time currency conversion
  • Local attraction and point-of-interest discovery
  • Budget tracking and expense management (premium)
  • Translation tools (premium)
  • Itinerary planning and trip organization (premium)
  • Offline maps for travel without connectivity (premium)

Important Disclaimer: WanderSmart provides travel information for general guidance purposes. Navigation data, weather forecasts, currency rates, and attraction details may not always be perfectly accurate or up-to-date. Always verify critical travel information through official sources and exercise personal judgment when traveling.

Eligibility

You must be at least 13 years old to use WanderSmart. By using the App, you represent that you meet this age requirement. If you are under 18, you should use the App under parental or guardian supervision.

Account Responsibilities

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Subscriptions and Payments

Free Features

WanderSmart offers free features including GPS navigation, weather forecasts, currency conversion, and local attraction discovery.

Premium Subscription

Premium features are available through auto-renewable subscriptions, which may include:

  • Budget tracking and expense management
  • Translation tools for multiple languages
  • Advanced itinerary planning
  • Offline maps for travel without internet

Billing

Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Location Services

WanderSmart uses your device's GPS and location services to provide navigation, weather, and local discovery features. You may disable location access at any time through your device settings, but this will limit the functionality of these features. We do not track your location when the app is not actively in use.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems to access the App
  • Share your account credentials with others
  • Use navigation features while driving without a hands-free setup

Intellectual Property

All content, features, and functionality of WanderSmart -- including but not limited to text, graphics, logos, icons, map interfaces, navigation algorithms, and software -- are owned by SketchMyApp LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

NAVIGATION DIRECTIONS, WEATHER FORECASTS, CURRENCY RATES, AND ATTRACTION INFORMATION ARE PROVIDED FOR GENERAL GUIDANCE ONLY. WE MAKE NO GUARANTEES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THIS INFORMATION. ALWAYS EXERCISE PERSONAL JUDGMENT AND VERIFY CRITICAL TRAVEL DETAILS THROUGH OFFICIAL SOURCES.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHMYAPP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ITS NAVIGATION, WEATHER, OR TRAVEL INFORMATION.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless SketchMyApp LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the App and contacting us to remove your data.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
