Agreement to Terms
By downloading, installing, or using the HomeTrack AI mobile application ("HomeTrack AI" or "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. HomeTrack AI is operated by SketchMyApp LLC ("we," "us," or "our").
Service Description
HomeTrack AI is a property search and analysis application that provides:
- Property search powered by third-party listing data
- Insurance claim history lookups for properties
- AI-powered property risk assessments
- Downloadable PDF property reports
- Real estate agent finder
- Home maintenance tracking tools
Important Disclaimer: HomeTrack AI provides property information for general reference purposes only. It is not a substitute for professional home inspections, appraisals, or legal due diligence. Property data, claim histories, and AI risk assessments may contain inaccuracies or be incomplete. Always conduct your own due diligence and consult qualified professionals before making real estate decisions.
Eligibility
You must be at least 18 years old to use HomeTrack AI. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
Account Responsibilities
When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
Subscriptions and Payments
Free Features
HomeTrack AI offers free features including basic property search, limited property details, and home maintenance tracking.
Pro Subscription
Pro features are available through auto-renewable subscriptions:
- Monthly: $9.99 USD per month
- Yearly: $99.99 USD per year
Pro includes unlimited property reports, full claim history access, AI risk assessments, and PDF report generation.
Individual Report Purchases
Non-subscribers may purchase individual property reports for $9.99 each as a one-time in-app purchase.
Billing
Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Cancellation
You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
Data Accuracy and Third-Party Content
Property listings, insurance claim histories, and other property data are sourced from third-party providers. We do not independently verify, endorse, or guarantee the accuracy, completeness, or timeliness of any third-party data displayed in the App.
AI-generated risk assessments are algorithmic estimates based on available data and should not be relied upon as the sole basis for any real estate or insurance decision. AI analysis may not account for all relevant factors affecting a property.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Scrape, harvest, or bulk-download property data from the App
- Redistribute property reports or claim history data commercially
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Use automated systems to access the App
- Share your account credentials with others
- Use property data to discriminate against individuals or groups in violation of fair housing laws
Intellectual Property
All content, features, and functionality of HomeTrack AI -- including but not limited to text, graphics, logos, icons, AI models, report templates, and software -- are owned by SketchMyApp LLC and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Property reports you generate are licensed for your personal use and may be shared with your real estate professionals.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
PROPERTY DATA, CLAIM HISTORIES, AND AI RISK ASSESSMENTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. WE MAKE NO GUARANTEES REGARDING THE ACCURACY OR COMPLETENESS OF PROPERTY DATA OR THE RELIABILITY OF AI-GENERATED ASSESSMENTS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKETCHMYAPP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR FINANCIAL LOSSES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON PROPERTY DATA, CLAIM HISTORIES, OR AI ASSESSMENTS.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold harmless SketchMyApp LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, reliance on property data or AI assessments, or violation of these Terms.
Termination
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the App and contacting us to remove your data.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
